ClinicTech Patient Portal — General Disclaimer

Please read this Disclaimer carefully before creating an account or using the ClinicTech Patient Portal.

By creating an account or accessing the ClinicTech Patient Portal (the “Portal”), you acknowledge that you have read, understood, and agree to the terms of this Disclaimer. If you do not agree, do not create an account or use the Portal. In this Disclaimer, “ClinicTech”, “we”, “our”, and “us” refer to CKP Solutions Pty Ltd trading as ClinicTech.

1. Not a Substitute for Professional Medical Advice or Care

The Portal is a personal health management tool that helps you store and organise your own health information — including documents you upload, medications and supplements you record, summaries shared with you by your treating healthcare provider, and personal health journals you create.

The Portal is not designed or intended to provide medical diagnosis, prognosis, treatment recommendations, or any form of clinical advice. ClinicTech has implemented safeguards within the Portal's AI features intended to prevent the generation of diagnostic or treatment suggestions. However, no automated system is infallible, and these safeguards cannot be guaranteed to prevent every unintended output.

If, despite these safeguards, the Portal produces any content that appears to suggest a diagnosis, treatment, dosage change, or course of action, you must:

  • not act on it without first consulting a qualified and registered healthcare professional; and
  • have it independently validated by your treating healthcare professional before relying on it for any health decision.

Always seek the advice of a qualified and registered healthcare professional regarding any medical condition, symptom, medication, supplement, or treatment plan. Never disregard, delay, or alter professional medical advice because of information you have read, recorded, or generated within the Portal.

2. Emergencies and Crisis Situations

The Portal is not designed for, and must not be used in, an emergency. If you are experiencing a medical emergency, severe symptoms, or a mental health crisis, call 000 (Triple Zero) immediately or go to your nearest emergency department.

ClinicTech does not monitor Portal activity in real time. Uploading documents, recording journal entries, or otherwise using the Portal is not a method of contacting your healthcare provider or any emergency service.

3. AI-Generated Content and Limitations

Certain Portal features may use artificial intelligence (“AI”) to help organise, summarise, extract, or surface information from data you have stored. While AI can be a useful organisational aid, it has important limitations. AI may:

  • generate inaccurate, incomplete, or misleading information (“hallucinations”);
  • reflect biases present in its training data;
  • misinterpret medical terminology, abbreviations, or context; and
  • fail to account for your unique medical history or current condition.

AI-generated content within the Portal is provided for your personal, informational use only. It is not a clinical assessment and must not be relied upon as a basis for medical decisions. As described in Section 1, the Portal's AI features include safeguards intended to prevent the generation of diagnostic or treatment suggestions, but those safeguards are not guaranteed to be effective in every case. If you encounter AI-generated content that appears to provide a diagnosis, treatment recommendation, or other clinical advice, you must not rely on it, and we encourage you to report it via the Portal's feedback mechanism. ClinicTech does not warrant the accuracy, completeness, or reliability of any AI-generated content.

4. Information You Enter or Upload

You are responsible for the accuracy and completeness of the information you enter into or upload to the Portal, including details about medications, supplements, allergies, conditions, symptoms, and personal observations. The Portal cannot independently verify your information. Inaccurate or incomplete information may produce inaccurate or misleading summaries, reminders, or other Portal outputs. Always confirm important health information — particularly medication names, dosages, and allergies — directly with your treating healthcare professional.

5. Information Shared by Your Treating Healthcare Provider

Your treating healthcare provider, where they use the ClinicTech clinician platform, may share consultation summaries, care plans, or other materials with you through the Portal. These materials are reviewed and approved by your healthcare provider before being released to you. The clinical content is authored by your healthcare provider — ClinicTech does not author, edit, review, or validate the clinical content of these materials.

If you have questions about anything your healthcare provider has shared, contact them directly. Unless a specific Portal feature is provided for that purpose, the Portal is not a means of clinical communication and we do not forward your messages, journal entries, or other Portal data to your healthcare provider without your direction.

6. Health Journal

Health journal entries are intended as a personal record. They are not reviewed by ClinicTech, are not automatically shared with your healthcare provider, and are not a substitute for therapy, counselling, or other professional support. The Portal does not monitor journal entries for indicators of distress or risk.

7. Sharing Information with Others

The Portal may, now or in future, allow you to share specific health information with selected recipients — including family members, carers, or healthcare professionals — based on the preferences you configure within the Portal.

Where you choose to share information:

  • You control what is shared and with whom. Sharing only occurs based on the preferences you set. You are responsible for choosing recipients carefully and reviewing what each recipient can access.
  • You are responsible for the accuracy and appropriateness of the information you choose to share, and for satisfying yourself that recipients — particularly any healthcare professional recipients you nominate — are who you believe them to be.
  • Recipients are not bound by your agreement with ClinicTech. Once information is shared with another person, that person's use, storage, and onward disclosure of the information is outside ClinicTech's control. ClinicTech is not responsible for the conduct of any recipient.
  • Some sharing cannot be fully reversed. Even if you later revoke access through the Portal, recipients may already have viewed, copied, downloaded, or further shared the information. Revocation prevents future access but does not retrieve information already received.
  • Healthcare professional recipients remain bound by their own professional, ethical, and legal obligations. However, ClinicTech does not verify the registration status, credentials, or identity of any recipient you choose to share information with.

You may manage your sharing preferences and revoke future access at any time through the Portal's sharing settings, subject to the limitations above.

8. Notifications and Reminders

The Portal may send notifications, alerts, or reminders to your registered device(s) — for example, medication and supplement reminders, alerts when a new consultation summary is shared with you by your healthcare provider, or notices about activity in your account. These notifications are intended as a convenience to support your personal management of your health information.

You must not rely on Portal notifications or reminders as a primary or sole means of taking medication, managing your health regimen, or staying informed of clinical communications.

Notifications may be delayed, suppressed, missed, or not delivered for many reasons outside ClinicTech's control, including (but not limited to):

  • your device being switched off, locked, in airplane mode, or out of network coverage;
  • operating-system or app-level notification permissions being disabled or restricted;
  • battery optimisation, focus mode, “do not disturb”, or similar settings on your device;
  • outages or delays at third-party push notification services (such as Apple Push Notification service or Firebase Cloud Messaging);
  • internet connectivity issues; and
  • planned or unplanned Portal maintenance or outages.

Accordingly:

  • Medication and supplement reminders are an aid to memory only. You remain solely responsible for taking medications and supplements as prescribed by, or otherwise instructed by, your healthcare professional. The absence of a reminder is not an instruction to skip a dose, and the presence of a reminder is not a medical instruction or advice. If a reminder conflicts with the instructions of your healthcare professional, follow your healthcare professional's instructions.
  • Notifications about clinical content (such as new consultation summaries) are sent on a best-effort basis. The absence of a notification does not mean no such content has been received in your account — when in doubt, check the Portal directly.
  • You are responsible for keeping your device, contact details, and notification settings in a state that allows notifications to be delivered, if you wish to receive them.

You may enable, disable, or configure notification preferences within the Portal at any time. ClinicTech does not warrant that any notification will be delivered, delivered on time, or received by you.

9. Privacy and Data Security

ClinicTech handles your personal information, including health information, in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any applicable state or territory health records legislation. Our Privacy Policy explains how we collect, use, store, share, and protect your information, and you are encouraged to read it carefully.

While we apply reasonable technical and organisational security measures, no internet-connected system can guarantee absolute security. You acknowledge the inherent risks associated with transmitting and storing information online.

10. Your Account

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity that occurs under your account; and
  • the accuracy of the information stored in your account.

You must notify ClinicTech immediately if you suspect unauthorised access to your account. If you choose to share access to your account or its contents with another person, you do so at your own risk and remain subject to the sharing terms in Section 7.

11. Acceptable Use and Account Restrictions

You may only use the Portal lawfully, in good faith, and for the personal management of your own health information (or, in future, the health information of a person for whom you become an authorised custodian under additional terms).

You agree not to:

  • (a) use the Portal for any unlawful, fraudulent, deceptive, or harmful purpose;
  • (b) create or maintain multiple or duplicate accounts, create an account in a false name, or impersonate another person;
  • (c) upload, store, or share information about another person without that person's authority and consent (including any health information of another individual);
  • (d) attempt to access, probe, scan, reverse engineer, decompile, or interfere with the Portal's infrastructure, security mechanisms, or source code;
  • (e) introduce viruses, malware, or other harmful code into the Portal;
  • (f) attempt to circumvent, defeat, or “jailbreak” any safeguard in the Portal, including those designed to prevent the AI from generating diagnostic, treatment, or clinical advice outputs;
  • (g) extract, scrape, harvest, or collect data from the Portal by automated means, except as expressly permitted in writing by ClinicTech;
  • (h) use the Portal to harass, threaten, defame, abuse, or otherwise harm any other person, including ClinicTech personnel or any healthcare professional whose content is shared through the Portal;
  • (i) use the Portal for any commercial purpose, including resale of features, training of third-party AI models on content sourced from the Portal, or unauthorised research;
  • (j) misrepresent yourself, your identity, your relationship with any healthcare professional, or any information shared through the Portal;
  • (k) misuse the sharing features (Section 7) or notification features (Section 8) in a manner contrary to their intended purpose; or
  • (l) breach any other term of this Disclaimer or any other terms applicable to the Portal.

ClinicTech reserves the right, acting reasonably and in its discretion, to:

  • investigate any suspected misuse, breach, or misappropriation of the Portal or any account, whether reported by another user, a healthcare provider, a third party, or detected by ClinicTech's own systems;
  • restrict, suspend, or limit any feature available to your account;
  • suspend or terminate your account; and
  • delete, quarantine, or restrict access to content associated with your account,

where ClinicTech reasonably believes that you have breached this Disclaimer, applicable law, or any other terms applicable to the Portal, or where such action is necessary to protect the Portal, other users, ClinicTech, or any third party from harm or risk of harm. Where reasonable and appropriate, ClinicTech will notify you of any such action and provide an opportunity to respond, except where doing so would compromise an investigation, breach a legal obligation, or create further risk.

If your account is restricted, suspended, or terminated:

  • you remain responsible for any obligations accrued before the action;
  • your access to the Portal and to information stored within it may be limited or removed; and
  • ClinicTech will handle any retained or deleted information in accordance with the Privacy Policy and applicable law.

You may report suspected misuse of the Portal — including by other users — by contacting info@clinictech.com.au.

12. Eligibility

You must be aged 18 years or older to create and hold an account on the Portal. By creating an account, you confirm and warrant that you are at least 18 years of age. The Portal is not currently available for use by individuals under 18.

ClinicTech may, in future, introduce features allowing parents, guardians, or carers to add minors as dependents under a custodian account. Any such features will be governed by additional terms (including verification of guardianship and additional safeguards) and will not be available until those terms are introduced.

If ClinicTech becomes aware that an account has been created by a person under 18, we may suspend or close that account.

13. No Warranty

The Portal is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, except for any consumer guarantees that cannot be excluded under the Australian Consumer Law or other applicable law. ClinicTech does not warrant that the Portal will be uninterrupted, error-free, secure, or free from harmful components.

14. Platform Evolution and New Features

The Portal is under active development. ClinicTech may, from time to time:

  • introduce new features, capabilities, or integrations (including new sharing options, new AI capabilities, new notification types, and integrations with external services or devices);
  • modify, improve, or replace existing features;
  • limit, suspend, or discontinue features that are no longer supported; and
  • change the technical infrastructure or service providers underlying the Portal.

Where new features involve materially different uses of your information, ClinicTech will:

  • notify you of the new feature and any associated terms, risks, or settings; and
  • where required by law or by our Privacy Policy, obtain your additional consent before activating the feature for your account.

You acknowledge that the Portal you use today may differ from the Portal as it evolves over time. Your continued use of the Portal following the introduction of new features or changes to existing features constitutes your acceptance of those changes, subject to any additional consent ClinicTech is required to obtain.

15. Limitation of Liability

To the fullest extent permitted by law (and subject to any non-excludable rights under the Australian Consumer Law), ClinicTech, its affiliates, officers, directors, employees, agents, suppliers, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, or any adverse health-related outcome — arising out of or in connection with:

  • (i) your access to, use of, or inability to access or use the Portal;
  • (ii) any content generated by or stored within the Portal, including AI-generated content;
  • (iii) any conduct or content of any third party on or through the Portal, including content shared by your healthcare provider;
  • (iv) any decision you make, or fail to make, in reliance on the Portal;
  • (v) unauthorised access to or alteration of your information;
  • (vi) any use, disclosure, or onward sharing of your information by recipients you have chosen to share information with through the Portal;
  • (vii) any introduction, modification, suspension, or discontinuation of any Portal feature;
  • (viii) any failure, delay, suppression, or non-delivery of any notification, reminder, or alert generated by the Portal; and
  • (ix) any restriction, suspension, or termination of your account, or removal of any content, taken in accordance with Section 11,

whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not ClinicTech has been advised of the possibility of such damage. Where liability cannot be excluded under applicable law, ClinicTech's liability is limited to the maximum extent permitted by that law.

16. Indemnity

You agree to indemnify and hold harmless ClinicTech from and against any loss, damage, or claim arising out of: (a) your breach of this Disclaimer (including Section 11); (b) information you submit, upload, or share through the Portal; or (c) your use of any Portal feature in a manner contrary to this Disclaimer or applicable law. This clause does not apply to the extent the loss, damage, or claim arises from ClinicTech's own negligence or wilful misconduct.

17. Changes to this Disclaimer

ClinicTech may modify or update this Disclaimer from time to time to reflect changes in the Portal, our practices, applicable law, or industry standards. We will:

  • post the updated Disclaimer within the Portal, with a clearly visible “Last Updated” date;
  • where the changes are material, notify you in advance through the Portal, by email, or both; and
  • where required by law, obtain your renewed acceptance of the updated Disclaimer before continued use.

Your continued use of the Portal after an update takes effect constitutes your acceptance of the updated Disclaimer. If you do not accept an update, you must stop using the Portal and may close your account.

18. Governing Law

This Disclaimer is governed by the laws of Victoria, Australia.
